Where the Marceno Investigations Stand: Federal Case Closed, Ethics Complaints Dismissed, One Lawsuit Open
A Nov. 1 status check of official records finds no federal charges and this year's ethics rulings in the sheriff's favor — and one new federal lawsuit from a former K-9 deputy, filed Oct. 23, that is only beginning.

Fort Myers — Three separate legal matters have followed Lee County Sheriff Carmine Marceno, and as of Nov. 1 they stand in three different places, according to a status report by The Digital Free Press based on official records: the federal investigation is closed without charges, the ethics complaints ruled on this year were dismissed, and a former deputy's federal lawsuit is in its earliest stage.
On the federal matter, WGCU reported on Nov. 18, 2025, that a letter to the sheriff's attorney confirmed the FBI and the U.S. Attorney's Office had closed their case, a decision based on information presently known to the government. No charges were filed. The Florida Commission on Ethics complaints against Marceno that the commission ruled on this year were likewise dismissed, per the commission's own press releases.
The open matter is a lawsuit, not an investigation. In Elsaid v. Marceno, filed Oct. 23 in federal court in Fort Myers, former K-9 deputy Mark Elsaid claims he was retaliated against after calling Homeland Security Investigations during a 2022 human-smuggling stop. Those claims are allegations. The public docket shows a summons issued and a civil action order entered Oct. 26, and no answer from the sheriff appears on the docket yet.
The distinction matters for readers sorting headlines: a closed investigation and dismissed complaints are outcomes; a newly filed civil suit is the start of a process in which nothing has been decided. Fort Myers Watch News will report the Elsaid case as it moves, and only on what the record shows.
